These Terms of Service (“Terms”) govern your use of the Borrow My Watts platform operated by Borrow My Watts Inc. (“Company”), incorporated in Ontario, Canada. By creating an account or using the platform, you agree to these Terms.
1. The platform
Borrow My Watts provides a peer-to-peer marketplace that connects EV charger owners (“Hosts”) with electric vehicle drivers (“Drivers”). The Company is not a party to charging sessions and does not own or operate any chargers. We provide the platform technology and payment processing infrastructure only.
2. Host obligations
- You must own or have the legal right to list the charger.
- Your charger must be in a location accessible to drivers without requiring your presence.
- You are responsible for ensuring your charger is in safe working condition.
- You must keep your availability calendar up to date.
- Energy sold via the platform is for personal EV charging use only.
3. Driver obligations
- You may only use chargers for charging your own electric vehicle.
- You must arrive within the booked time window.
- You are responsible for any damage caused to the charger or host property during your session.
- You must not circumvent the booking system to use a charger outside a confirmed booking.
4. Payments and fees
Drivers are charged at the rate set by the Host. The Company charges Hosts a monthly subscription fee for platform access. Payments are processed by Stripe. A pre-authorization hold is placed at booking and captured at session completion based on actual energy delivered. All amounts are in Canadian dollars (CAD) and include applicable HST.
5. Cancellations and refunds
During the pilot period, all cancellations receive a full refund. Post-pilot cancellation policies will be published with at least 30 days notice.
6. Liability
The Company provides the platform “as is.” To the maximum extent permitted by Ontario law, we are not liable for losses arising from: charger malfunction, session interruptions, vehicle damage, or any other loss not directly caused by the Company’s gross negligence or willful misconduct. Host liability protection is provided subject to the terms of the applicable insurance policy.
7. Governing law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Disputes shall be resolved in the courts of Ontario.
